Massachusetts Grandparent’s Rights to Visitation: Visitation may be granted to grandparents if the child’s parents are divorced, married but living apart under a temporary order or judgment of separate support, one of the parents is deceased, or if the child was born out of wedlock and paternity established by a court or by acknowledgment by the father and the child’s parents live apart, if, of course, the visitation is in the child’s best interest. Chapter 119, Section 39D (A.L.M. Chapter 119 §39D). Must include "care and custody affidavit" with petition. When Adoption Occurs: Rights terminate upon adoption by anyone other than a stepparent.
